Federal law (FLSA) requires 1.5× pay for nonexempt hours over 40 in a workweek nationwide. A handful of states add daily overtime, double time, or wage-conditioned daily rules that can raise gross pay on long shifts even when the weekly total is under 40 hours on some days.

California daily + double time vs FLSA weekly-only

In Texas and most states, a 14-hour Monday followed by four 8-hour days (46 hours total) yields 6 hours of weekly OT at 1.5× on the hours over 40—about $980 at $20/hr in our model.

California pays daily OT after 8 hours and double time after 12 on that Monday (Labor Code §510 does not stack daily and weekly OT on the same hours—employers pay the greater classification)—about $1,000 on the same pattern, roughly $20 more than Texas before taxes.

Colorado triggers daily OT after 12 hours; Alaska after 8; Nevada after 8 only below $18/hr. Everyone else in this table uses weekly FLSA rules only.

Nevada’s $18/hr daily OT condition

At $20/hr our vignette, Nevada employees do not receive daily OT on the 8-hour days because the rate exceeds $18/hr; they still earn weekly OT on hours over 40 in the workweek.

At $17/hr the same schedule would activate Nevada daily OT after 8 hours in a day, narrowing the gap with California on long-day patterns.
